The Litigation Division of
the District Attorney’s Office processes all claims against Salt Lake
County and defends the County in all State and Federal Court lawsuits
filed against the County, its employee's and elected officials involving
claims of alleged civil rights violations, personal injury and property
damage.
The Division also provides legal counsel to
Salt Lake County on employment law issues and represents County agencies
and officials in employee disputes and terminations starting at the
administrative hearing level through and including a District Court
trial and appeals process when necessary.
The District Attorney also files lawsuits
on-behalf of the County to recover monies owed on bond forfeitures,
delinquent accounts, bad checks and in other areas.
Because public improvements such as parks,
roads, flood control projects, convention centers, golf courses and
other public recreation facilities often require the use of private
property for public use, the District Attorney’s Office initiates
procedures for purchase or use of the land. If negotiations for
purchase of these private properties are unsuccessful, Salt Lake County
may use the powers of “eminent domain” to begin condemnation
procedures to acquire the land. The Litigation Division represents
the County in the condemnation proceedings.
The Risk Management Program in the District
Attorney’s Office administers the County's Workers Compensation
Program for all agencies, employees and volunteers involved in
occupational injuries and illnesses. If the injured employee
rejects the compensation plan, a Litigation attorney will represent Salt
Lake County before the Utah State Labor Commission and the Utah Supreme
Court in the event of an appeal.
The District Attorney through Risk Management
also purchases property, liability and public official's liability
insurance coverage and excess workers compensation coverage. In an
effort to reduce exposure to on-the-job injuries and property damage,
the District Attorney’s Office provides on-site inspections and
training to Salt Lake County personnel.
